Sole Proprietor Ihor Ihorovych Tsuman, acting on the basis of the registration entry in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations under No. 2010350000000305657 dated May 8, 2023, and managing the website https://www.claviermus.com/, recognizing the importance of ensuring the confidentiality and inviolability of personal and confidential data of individuals who are users of the website, enters into this Privacy Agreement (hereinafter referred to as the “Agreement”) with you (hereinafter referred to as the “User”) in order to define the procedure for obtaining, storing, processing, using, and disclosing the User’s personal data while using the website https://www.claviermus.com/ (hereinafter referred to as the “Website”).

This Privacy and Personal Data Protection Policy (hereinafter referred to as the “Policy”) sets out the procedure for handling and processing personal data, the types of personal data collected, the purpose of using such personal data, interaction with third parties, security measures for the protection of personal data, conditions for access to personal data, as well as contact information for the user regarding access, correction, blocking, or deletion of their personal data and dealing with any questions you may have regarding personal data protection.

The User is not entitled to use the Website and the services provided by the Website (hereinafter referred to as the “Services”) if they do not agree with the terms of this Agreement.

The Privacy Policy of the Website applies to any use of this resource, i.e., to all of the resource’s services regardless of whether the user accesses the services or not, how the service is obtained or used, and whether it is accessed via a PC, the mobile version of the site, or a mobile application.

The website https://www.claviermus.com/ does not collect any information for the processing of which the legislation sets specific requirements, such as information about racial or ethnic origin, political, religious or philosophical beliefs, membership in political parties and trade unions, criminal convictions or sentences, as well as data concerning health, sexual life, biometric or genetic data (in accordance with Article 7 of the Law of Ukraine “On Personal Data Protection”).

 

II. TERMS

2.1. For the purposes of this Privacy Policy, the following terms shall have the meanings set forth below:

2.1.1. Personal Data – any information relating to an identified or identifiable individual, directly or indirectly. The purpose of collecting and processing personal data within the System is the storage and maintenance of user data in accordance with Articles 6 and 7 of the Law of Ukraine “On Personal Data Protection,” and the implementation of civil-law relations, sale and/or access to musical works, and settlement of payments for purchased musical works, in accordance with the Tax Code of Ukraine and the Law of Ukraine “On Accounting and Financial Reporting in Ukraine.”

2.1.2. Owner of the Personal Data Database – Ihor Ihorovych Tsuman, who, by consent of the personal data subject on the Website https://www.claviermus.com/, is granted the right to process such data, who approves the purpose of personal data processing in this database, determines the composition of these data and the procedures for their processing, unless otherwise provided by law.

2.1.3. Responsible Person – Ihor Ihorovych Tsuman, designated by the Owner of the Personal Data Database, who organizes activities related to the protection of personal data during its processing in accordance with the law.

2.1.4. Website – a set of data, electronic (digital) information, other objects of copyright and/or related rights, etc., interconnected and structured within the address https://www.claviermus.com/ all its subdomains.

2.1.5. The Website https://www.claviermus.com/ acts as an online store (marketplace) and positions itself as the “Website” for registration, sale, and provision of access to musical works. It facilitates interaction between the “Website” and Users for the purchase of musical works by providing access to files for download or streaming.

2.1.6. Protection Administrator – an access entity responsible for protecting the automated system from unauthorized access to information.

2.1.7. Processing of Personal Data – any action or set of actions involving collection, registration, accumulation, storage, adaptation, alteration, updating, use, and dissemination (distribution, sale, transfer), anonymization, destruction of personal data, including through the use of information databases.

2.1.8. Cookie Files – text file(s) containing a small amount of information sent to a web browser and stored on the user’s device, such as a computer, mobile phone, or other device used by the user to visit the Website.

2.1.9. Executor – Ihor Ihorovych Tsuman, who performs the sale and provides access to musical works by entering into the public offer agreement posted on the website: https://www.claviermus.com/. The activity is carried out by Ihor Ihorovych Tsuman, e-mail: claviermus@gmail.com, phone: +380680287158.

2.1.10. Customer (User) – any legally capable person who, in the manner provided by this Agreement, has fully accepted (acceded to) all its terms without exception.

2.2. For the purposes of this Privacy Policy, all terms defined in Section II of this Agreement shall be used exclusively with the meanings set forth in Section II of this Privacy Policy, regardless of whether these terms are used in singular or plural form, or in other grammatical cases and/or constructions.

2.3. All other terms not separately defined in this Privacy Policy shall be understood and interpreted in their literal grammatical meaning based on the provisions of current Ukrainian legislation, business customs, as well as the purpose and subject of this Agreement.

 

II. PURPOSE OF COLLECTION AND PROCESSING OF PERSONAL DATA

3.1. Purpose of using personal data:

3.1.1. Your personal data are used to fulfill the public offer agreement for the sale of musical works, as well as to ensure the operation of the online store located at https://www.claviermus.com/, the right to exchange information/news, relations in the field of advertising and communication, and to comply with the laws of Ukraine, including, but not limited to: “On Personal Data Protection,” “On the Ratification of the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data and the Additional Protocol to the Convention on the Supervision Authorities and Transborder Data Flows,” “On Information,” “On Advertising,” “On Telecommunications,” “On Information Protection in Information and Telecommunication Systems,” “On State Support of Mass Media and Social Protection of Journalists.”

3.2. Retention period of personal data:

3.2.1. Personal data shall be retained no longer than necessary for their processing purpose.

The Controller processes Users’ personal data in accordance with data protection legislation. Provided personal data are processed and may be stored in the Personal Data Database or a separate table of the Website Database.

3.3.2. Users’ personal data are processed, among other purposes, in the following areas:

- To perform public offer agreements concluded with the User – the legal basis for processing data in this case is the agreement concluded with the Controller by acceptance of the terms of this agreement on the Website https://www.claviermus.com/.

- To maintain the User’s account – the legal basis for data processing in this case is the agreement concluded with the Controller by creating an account and accepting the Website rules https://www.claviermus.com/.

- To inform the User of changes made by the Executor to the Offer Agreement by sending the amended version to the User’s email specified upon agreement and payment under the agreement.

- If the User consents, commercial information about musical works offered for sale, including promotional campaigns, may be sent to the User’s email or phone number – in this case, the legal basis for processing the User’s data is their consent, which is voluntary and may be withdrawn at any time.

- To send the User individual marketing messages, e.g., proposals for musical works based on the User’s profile analysis of previous orders – the legal basis for processing the User’s data here is the Controller’s legitimate interest in marketing musical works/content.

- For marketing purposes – the Controller will periodically send information about the Executor’s offers to the correspondence address provided by the User.

- For statistical purposes for the Controller’s internal needs – the legal basis for processing data is the Controller’s legitimate interest in collecting information to develop activities and adapt musical works to Users’ needs.

- To confirm the Controller’s fulfillment of obligations, handle claims, or protect against claims that may be directed against the Controller, prevent or detect fraud – the legal basis for processing the User’s data here is the Controller’s legitimate interest in protecting rights, confirming performance of obligations, and receiving appropriate remuneration from clients.

3.3.3. In performing the public offer agreement on the Website https://www.claviermus.com/, the User provides certain specified personal data necessary for the agreement’s execution. Failure to provide the data necessary to fulfill the order results in the Executor’s inability to perform the public offer agreement. Providing consent to receive commercial information at the specified email or phone number is optional. Consent, if given, may be withdrawn at any time. Withdrawal does not affect the lawfulness of processing before withdrawal.

3.3.4. The Website https://www.claviermus.com/ reserves the right to provide the User’s personal data to entities cooperating in the performance of the public offer agreement concluded with the User, including payment receipt or provision of other services related to the sale of musical works.

3.3.5. The personal data provided by the User will be processed for the period necessary to perform the public offer agreement, confirm the Controller’s obligations, and handle claims or protection against claims that may be directed against the Controller, but no longer than one year from the date the User provided their data to the Controller.

3.3.6. Under these conditions, the User has the following rights regarding the processing of their personal data by the Controller in connection with the operation of the Website https://www.claviermus.com/: the right to access data, update them, require data transfer, deletion, object to data processing, and request restriction of processing.

3.4. Use of cookie files

3.4.1. Cookies may be permanent (persistent cookies), stored on the user’s device until deleted, or temporary (session cookies), stored only until the browser is closed. - The User’s access to their personal data is free of charge.

- Deferral of User access to their personal data is not permitted.

- Deferral of access to third parties’ personal data is permitted if the necessary data cannot be provided within thirty calendar days from the date of the request. The total period for resolving issues raised in the request must not exceed forty-five calendar days.

- Notification of deferral must be provided in writing to the third party who made the request, including an explanation of how to appeal the decision.

- Decisions on deferral or denial of access to personal data may be appealed to the Ukrainian Parliament Commissioner for Human Rights or through court.

3.9. Rights of the personal data subject:

3.9.1. The Website https://www.claviermus.com/ informs you of your rights as a personal data subject regulated by the Law of Ukraine “On Personal Data Protection,” namely:

- To know the sources of collection, location of your personal data, purpose of their processing, location or residence of the owner or controller of personal data, or to authorize a representative to obtain such information, except as otherwise provided by law;

- To receive information about conditions for access to personal data, including information about third parties to whom personal data is disclosed;

- To access your personal data;

- To receive a response within thirty calendar days from the request date, except as otherwise provided by law, regarding whether personal data is processed and to receive the contents of such data;

- To submit a reasoned objection to the personal data owner against processing of your personal data;

- To submit a reasoned request to modify or destroy your personal data by any owner or controller if such data is processed unlawfully or is inaccurate;

- To protect your personal data against unlawful processing and accidental loss, destruction, or damage related to intentional concealment, failure, or untimely provision, as well as protection from providing inaccurate or defamatory information damaging honor, dignity, and business reputation;

- To file complaints about personal data processing with the Ukrainian Parliament Commissioner for Human Rights or court;

- To exercise legal remedies in case of violation of personal data protection laws;

- To make reservations concerning restrictions on the right to process personal data when giving consent;

- To withdraw consent to personal data processing;

- To know the mechanism of automated personal data processing;

- To protection against automated decisions that have legal consequences.

I, as the personal data subject, hereby give my consent to the processing of my personal data provided by me during registration and conclusion of the public offer agreement on the Website https://www.claviermus.com/, the activity of which is conducted by Ihor Ihorovych Tsuman, phone +380680287158, in the personal data database of the Website https://www.claviermus.com/. This consent is given for the purpose of ensuring the obligations assumed by the Owner of the personal data database and the Administrator, to maintain relations in the scope of execution of the public offer agreement, advertising, and conducting business relationships, sending (delivering) to my address special offers, information about new musical works, promotional campaigns, discounts, and other actions within the scope of their activity, as well as for the Owner of the personal data database to fulfill their obligations to me as a Customer of musical works, namely:

- surname, first name, patronymic, residential address, mobile phone number, other contact information, passport data, tax identification number (TIN), date of birth, registration place, and other information provided by me during registration and conclusion of the public offer agreement posted on the Website https://www.claviermus.com/, etc.;

- any other personal data and information voluntarily provided by the personal data subject to the Owner of the personal data database contained in documents submitted during questionnaire filling, surveys, application processing, other documents, and execution of concluded contracts, as well as data that may be required by the Owner of the personal data database in connection with the purpose of personal data processing, including passport data if provided.

I confirm my consent to all the above and acknowledge that I have been informed about the personal data Administrator; the purpose of personal data processing; the composition and content of personal data; persons to whom personal data may be transferred; I understand my rights under the Law of Ukraine “On Personal Data Protection,” and I undertake to comply with the Website Terms of Use.

I am aware that the Owner of the personal data database reserves the right to change the Website Terms of Use (Public Offer) and the Privacy Policy at their discretion.
